Tentazione di Siracusa, "Tentación de Siracusa", es el título que eligió Jacques Derrida (1930-2004) para la breve, aunque magistral, conferencia que pronunció el 18 de enero de 2001 en Ortigia, en el Palacio del Senado siracusano. Allí fue convocado por las autoridades del Collegio Siciliano di Filosofía y por el entonces intendente de la comuna sícula, Giambattista Bufardeci, quien le otorgó en tal ocasión la ciudadanía honoraria de esa antigua y culturalmente variada urbe mediterránea, una ciudad atravesada milenariamente por la (...) tensión entre filosofía y política, que vio partir por mar, reducido a esclavo, a Platón, y que se manchó con la sangre de Arquímedes, derramada por un soldado romano invasor. La lectio derridiana, que propone sin ambages una nueva figura para la relación entre filosofía y política, abordando el fenómeno de la "mundialización" así como la pregunta por el sentido contemporáneo de la ciudadanía, debió esperar casi dos décadas para ver la luz. Recién en 2018 la editorial Mimesis, sello italiano de incuestionable prestigio, la hizo accesible dentro de su colección "eterotopie", dirigida por los profesores Salvo Vaccaro (Università degli Studi di Palermo) y Pierre Dalla Vigna (Università dell'Insubria). Un frammento clinico -/- Lo chiamerò Carlo; ha cinquant’anni, una laurea e buona proprietà di linguaggio; è single, elegante, intelligente, seduttivo, eroinomane. Siamo alla sesta o settima seduta, e non ho ottenuto altro da lui che risposte letterali, e piuttosto banali, alle mie domande; lunghe descrizioni dei suoi molteplici disturbi fisici e altrettanto lunghi silenzi. Eppure di cose da dire ce ne sarebbero parecchie. E’ un brillante dirigente in una industria ingegneristica, ma recentemente lo ha investito un uragano. La sua (...) tossicodipendenza è stata casualmente scoperta sul lavoro ed è stato licenziato in tronco. Nell’arco di pochi mesi ha dovuto vendere il proprio appartamento; benché avesse un ottimo stipendio, Carlo ha infatti accumulato vari debiti, perché l’eroina e le prostitute costano cari. La sua lunga serie di fidanzate, rimpiazzabili al massimo dopo un paio di mesi, si è così rapidamente dileguata. Quando ho cominciato a leggere qualche articolo e a riflettere sul tema dell’etica in psicoanalisi, ho capito che mi ero infilato in un ginepraio. Da un lato potevo proporvi una sorta di manuale normativo su quello che si deve e non si deve fare nel corso di una psicoterapia: del resto, la maggior parte degli articoli che ho letto sono di questo genere. Però, anche trascurando il fatto che ogni teoria psicodinamica si differenzia dalle altre per lo meno nei dettagli (...) del setting, da queste letture io ne ho ricavato poco, e ho pensato che sarebbe stato così anche per voi. E’ difficile capire in che cosa i manuali normativi si differenziano dalla semplice prescrizione di buon senso e di onestà intellettuale. E soprattutto quando questi ingredienti mancano non credo possano essere recuperati con la lettura di un articolo. (shrink)

Pierre Bourdieu si è misurato a lungo con la definizione del “quadro concettuale” della “teoria della società”, a partire dalla riflessione sul rapporto non chiarito fra la “teoria dell’azione” e la “teoria strutturalista”, ossia dalla questione preliminare di come le due principali strategie concettuali attraverso cui si sono orientate le scienze sociali si possano integrare in un “modello unitario”. La “prospettiva relazionale” indaga la genesi, lo sviluppo e la crisi tanto delle strutture sociali quanto delle rappresentazioni, dei (...) comportamenti e dei vissuti soggettivi che si manifestano all’interno di tali strutture, focalizzando l’analisi sui sistemi di relazioni tra oggetti ed eventi piuttosto che sui singoli fenomeni. Bourdieu tenta di superare il tradizionale antagonismo tra la “fisica oggettivista” dello strutturalismo e il “soggettivismo costruttivista” della fenomenologia e della teoria dell’azione, mettendo in relazione la riproduzione-distribuzione delle risorse materiali (“oggettività di primo ordine”) e degli schemi mentali e corporei tramite cui sono interpretate, valutate e vissute le situazioni e si rinnova simbolicamente la società (“oggettività di secondo ordine”). Come vedremo, i concetti di capitale e di habitus a disposizione dei soggetti individuali e collettivi all’interno dello spazio sociale e dei campi specifici caratterizzano tale indagine. (shrink)

_Riassunto_: Questo lavoro intende offrire una prospettiva sulla filosofia della mente implicita nell’opera di Pierre Bourdieu. Propongo di organizzare e analizzare le questioni psicologiche che si dipanano nella teoria della pratica di Bourdieu su due diversi piani descrittivi della sfera del mentale: quello ontologico e quello architettonico. Nella prima parte del lavoro chiarirò il concetto di habitus sulla base della sua costituzione schematica. Poi, definito l’habitus come “super-schema psicosociale”, esplorerò il suo funzionamento incarnato alla luce della teoria cognitiva della (...) metafora. Nella seconda parte del lavoro, intendo chiarire l’architettura del mentale che emerge dalla relazione che Bourdieu teorizza tra conoscenza pratica e conoscenza riflessiva. Qui, vorrei prima sottolineare come Bourdieu faccia uso di un’architettura duale della mente, segnata da una particolare doppia-opacità riflessiva, per sostenere poi che le affermazioni metacognitive di Bourdieu ben si adattano agli approcci contemporanei della parità sé-altro della conoscenza di sé. I propose to organize and analyse the psychological themes that flow trough Bourdieu’s theory of practice using two different levels of description of the mental, the ontological and architectonic. In the first part of the article, I clarify the concept of habitus on the ground of its schematical constitution. Conceptualising habitus as a “psychosocial super-schema”, I explore its embodied functioning in the light of cognitive metaphor theory. In the second part, I clarify the architecture of the mental as it emerges from the relationship Bourdieu theorizes between practical and reflexive knowledge. Here, I first stress that Bourdieu employs a dual architecture of mind marked by a peculiar reflexive double-opacity, and then I argue that Bourdieu’s metacognitive claims fit the contemporary self-other parity accounts of self-knowledge. Uno studio filosofico sull’etica è sempre di grande attualità. E in questo «dappertutto vi circola la passione per la verità e per il bene» (dalla Presentazione di Carmelo Vigna). Mai come oggi si parla di salute e di benessere, probabilmente perché si percepisce la mancanza di entrambi. In Occidente è così. L’etica si affaccia alla riflessione umana rivestita con i panni di un’etica filosofica, prima ancora che ulteriormente aggettivata, essendo una terminologia che rimanda, come è risaputo, ad Aristotele. (...) Con «etica» si intende oggi quel confine oltre cui non si può più andare, discutere, transigere, indagare: per questo – e correttamente – si parla rispettivamente di «confini etici», «indole etica » o non, «bioetica», «decisione etica», «comportamento etico» e così via. In qualche modo con «etica» si intende ciò che si impone ancor più della scienza o della decisione democratica. L’«etica» pone in questione il baluardo sollevato proprio da queste ultime due. Sanando la questione. Il modo, talvolta, sfugge, diventando, così, ambito proprio della filosofia e della sua visione interale. Questa è esattamente l’etica filosofica. Questo libro affronta temi di grande importanza e fascinosi, quali il bene, il male, la bontà, la crudeltà, la ragione, il sentimento, il «senso morale», la coscienza, la responsabilità, la Stato e la nazione. Italian Abstract: Per giustificare l’autorità e la validità della scienza economica, gli economisti sono spesso ricorsi all’argomento che le leggi e i postulati di questo sapere sono verità scientifiche, nel senso di verità empiriche, logiche o autoevidenti. Tuttavia, questo discorso, in quanto discorso legittimante o discorso sull 'importanza' della scienza economica, sembra contraddire una siffatta argomentazione giacché non statuisce né verità empiriche né verità logiche, e tanto meno verità autoevidenti. A quale tipo di verità, allora, fa riferimento la predica della (...) scienza economica? Perché la scienza economica, in quanto sapere, viene predicata come una ‘legge’ a cui bisognerebbe obbedire? Esiste un legame storico e teoretico tra la struttura giuridico-politica della legittimità e la predica, la retorica e/o il discorso della scienza economia nella sfera pubblica? In che senso un sapere è un 'istituzione'? -/- In questo articolo esamino il ‘caso Einaudi’ come exemplum dei discorsi sulla scienza economica fatti dagli economisti nella sfera pubblica. Analizzando la predicazione e la riflessione epistemologica di Einaudi e confrontandola con quella di Pareto, Robbins, Weber e Schumpeter, vedremo come sullo sfondo di note dicotomie quali positivo/normativo, fatti/valori, essere/dover essere, analisi/visione, si stagli la contrapposizione epistemologico-antropologica tra Ragione e passioni, spesso assimilata a un’altra perdurante antitesi: Ragione e fede. Muovendo dalla prospettiva dell’«antropologia dogmatica» di Pierre Legendre, e attraverso un rovesciamento solo apparentemente paradossale delle categorie giuridiche e teologiche presenti nel discorso einaudiano, cercherò di formulare una nozione di normatività della scienza economica, estendibile anche ad altri saperi, in vista di un superamento della (falsa) contrapposizione tra Ragione e passioni. -/- English Abstract: To legitimate the authority and the validity of the economic science, economists have often claimed that the laws and the postulates of this savoir are scientific truths, in the sense of empirical, logical or self-evident truths. However, this discourse, as a legitimating discourse, or as a discourse on the ‘significance’ of the economic science, seems to contradict such a claim since it does not assert either empirical, logical or self-evident truths. To what type of truth, then, does the preaching of the economic science refer? Why is the economic science, as a savoir, preached as a ‘law’ to which one should obey? Is there an historical and theoretical nexus between the legal-political structure of the legitimacy and the preaching, rhetoric or discourse of the economic science? What does it mean that a savoir is an ‘institution’? -/- In this article I examine the ‘Einaudi case’ as an exemplum of the discourses on the economic science done by economists in the public sphere. Analysing Einaudi’s preaching and epistemological speculation and comparing it with that of Pareto, Robbins, Weber and Schumpeter, I will show how from the background of well known dichotomies – such as positive/normative, fact/values, to be/ought to be, analysis/vision – the epistemological-anthropological opposition between Reason and passions emerges. This opposition is often assimilated to another long-lasting antithesis: that between Reason and faith. Moving from the perspective of Pierre Legendre’s «dogmatic anthropology», and by an apparently paradoxical reversal of the juridical and theological concepts of Einaudi’s discourse, I will try to formulate a notion of normativity of economic science, which is also applicable to other sciences, in view of an overcoming of the (false) opposition between Reason and passions. We propose a modular ontology of the dynamic features of reality. This amounts, on the one hand, to a purely spatial ontology supporting snapshot views of the world at successive instants of time and, on the other hand, to a purely spatiotemporal ontology of change and process. We argue that dynamic spatial ontology must combine these two distinct types of inventory of the entities and relationships in reality, and we provide characterizations of spatiotemporal reasoning in the light of the interconnections (...) between them. Sul piano terminologico, ontologico, percettivo, fenomenologico, psicologico, storico-musicale, l'articolo discute in successione le categorie interconnesse di suono, oggetto sonoro (anche nell'accezione proposta dalla scuola di Pierre Schaeffer), oggetto uditivo e oggetto musicale, in particolare alla luce degli sviluppi della musica contemporanea postonale. Una differenza fondamentale è rinvenuta tra il livello fisico di esistenza del suono (che ha quattro dimensioni: tempo, frequenza, ampiezza, spazio) e il livello fenomenico di esistenza degli oggetti uditivi (che sono considerati come rappresentazioni mentali, dotate (...) di cinque dimensioni elementari: durata, altezza, intensità, timbro, spazio). Durante il Novecento la musica ha espanso gradualmente i propri confini, arrivando a includere qualsiasi tipo di oggetto sonoro (quindi il rumore, nonché tutti i suoni dell'intera realtà extra-artistica). Inoltre certi stili musicali (ad esempio il minimalismo, la drone music, lo spettralismo) hanno valorizzato quello che si può definire “oggetto musicale minimo”: la più piccola differenza percettivamente saliente in una qualsiasi delle cinque dimensioni. Ciò comporta che un oggetto musicale può essere qualcosa di più piccolo di un suono definito nelle sue quattro dimensioni. Una riflessione speciale è dedicata alla categoria di timbro, che diventa il campo di elaborazione principale per i compositori delle tendenze postonali; poi alla categoria di durata, che non coincide con quella di tempo e in musica è fatta oggetto di un’elaborazione specifica. Through a detailed study of Spinoza's concept of 'experience', Moreau shows how Spinoza extends the power of reason to capture the singularity of individuals: their lives, languages, passions and societies.

In this article, we develop tame topology over dp-minimal structures equipped with definable uniformities satisfying certain assumptions. Our assumptions are enough to ensure that definable sets are tame: there is a good notion of dimension on definable sets, definable functions are almost everywhere continuous, and definable sets are finite unions of graphs of definable continuous “multivalued functions.” This generalizes known statements about weakly o-minimal, C-minimal, and P-minimal theories.

In this article, Pierre Hadot examines the late philosophy of Ludwig Wittgenstein and the so-called “linguistic turn” in philosophy and the social sciences. Although certain interpreters of Wittgenstein have thought that Philosophical Investigations shows philosophy to be predicated on a series of confusions based on the misuse of language, Hadot argues contrarily that an understanding of Wittgenstein’s idea of “language games”—far from ending philosophy—allows us to see it anew and to discern the source of some of its deepest perplexities. (...) Of particular concern is the notion of the ancient idea of philosophical discourse as intrinsically connected to various forms of apprenticeship or spiritual formation. It is in this context that the supposed inconsistencies and unusual repetitions of ancient philosophy can be understood. Only from the Middle Ages do philosophical language games begin slowly to become detached from certain kinds of training, of pedagogies connected to forms of life, and become texts—and “systems”—in the sense of being written for the purposes of merely conventional reading. Drawing on various resources and requirements (as expressed by Dewey, Wittgenstein, Sellars, and Brandom), this paper proposes an externalist view of conceptual mental episodes that does not equate them, even partially, with vehicles of any sort, whether the vehicles be located in the environment or in the head. The social and pragmatic nature of the use of concepts and conceptual content makes it unnecessary and indeed impossible to locate the entities that realize conceptual mental episodes in non-personal or subpersonal contentful (...) entities (vehicles). Persons, who engage in social practices of deontic scorekeeping (Brandom), and who are thus able to produce appropriate inferential behaviour, enact conceptual mental episodes and the basis of their supervenience. We study invariant types in NIP theories. Amongst other things: we prove a definable version of the [Formula: see text]-theorem in theories of small or medium directionality; we construct a canonical retraction from the space of [Formula: see text]-invariant types to that of [Formula: see text]-finitely satisfiable types; we show some amalgamation results for invariant types and list a number of open questions.

In mass democracies, voting—in elections or referendums—is the main way in which most citizens can publicly express their political preferences. And yet this means of expression is sometimes perceived by them as highly frustrating, partly because it does not allow for much expression. Dominant voting methods lead to a reduction of options, pressure citizens to vote tactically at the cost of expressing their genuine preferences, and fail to convey what they really think about different candidates, parties, or options. Yet citizens (...) do not merely have a right to vote; they have a more fundamental right to political expression from which one can derive a right to a voting method that offers the most opportunities for expression among those satisfying other important requirements. The aim of this article is therefore to add this consideration about the importance of political expression to debates about voting methods that have mainly been conducted from the perspective of social choice theory. To illustrate what is at stake, it introduces evaluative voting methods (allowing voters to grade all of the candidates, parties, or options) as a promising way of honoring the right to political expression without jeopardizing other important properties of voting methods. Crucial in Pierre Hadot’s account of ancient philosophy as a way of life is the phenomenon of conversion. Well before he encountered some of the decisive influences upon his understanding of philosophy, Hadot already understood ancient philosophy and its long legacy in later thinkers of the West as much more than a formal discourse. Philosophy is an experience, or at least the exploration and articulation of a potential for experience. The energy of this potential originates in a polar tension (...) between epistrophe and metanoia. The two poles, which are grounded in primal experiences of the living organism, motivate and model the conversion which must be lived by the philosopher. The genius of Western philosophical experience lies in the effort to synthesize return and rebirth, and thereby recover the self as an ontological point of identification with and origin of the cosmos. Here we are witness to the great cultural event of the West, the emergence of a Latin philosophical language translated from the Greek. Once again, it would be necessary to make a systematic study of the formation of this technical vocabulary that, thanks to Cicero, Seneca, Tertullian, Victorinus, Calcidius, Augustine, and Boethius, would leave its mark, by way of the Middle Ages, on the birth of modern thought. Can it be hoped that one day, with current technical means, it will (...) be possible to compile a complete lexicon of the correspondences of philosophical terminology in Greek and Latin? Furthermore, lengthy commentaries would be needed, for the most interesting task would be to analyze the shifts in meaning that take place in the movement from one language to another. In the case of the ontological vocabulary the translation of ousia by substantia, for example, is justly famous and has again recently inspired some remarkable studies. This brings us once more to a phenomenon we discretely alluded to earlier with the word philosophia, and which we will encounter throughout the present discussion: the misunderstandings, shifts or losses in meaning, the reinterpretations, sometimes even to the point of misreading, that arise once tradition, translation, and exegesis coexist. So our history of the Hellenistic and Roman thought will consist above all of recognizing and analyzing the evolution of meanings and significance. Pierre Hadot holds the chair of the History of Hellenistic and Roman Thought at the Collège de France. He is the author of many books and articles on the history of ancient philosophy and theology. L’articolo è l’estratto di un più ampio lavoro ancora in corso. Come Michel Foucault e Pierre Hadot, ognuno dalla propria postazione storico-teorica, ci hanno ricordato, la filosofia antica, ed in particolare quella ellenistica con i cinici e gli stoici, non era solo un discorso ma una concreta pratica di vita, un comportamento esistenziale proposto come modello per tutti coloro che intendevano raggiungere l’arete. Il testimone di questa “arte della vita” −è la tesi di fondo di questo contributo− non (...) è stato però storicamente raccolto dalla filosofia moderna −impersonale, tecnicistica, professionalizzata− ma dall’ètimo stesso delle correnti più significative delle arti moderno-contemporanee, impegnate non a produrre l’“opera d’arte” nel senso classico-tradizonale del termine, ma a proporre pratiche e modelli di vita creativi. L’esempio che qui abbiamo trascelto riguarda la pedagogia teatrale del famoso regista polacco Jerzy Grotowski. (shrink)

Criticisms and rejections of representationalism are increasingly popular in 4E cognitive science, and especially in radical enactivism. But by overfocusing our attention on the debate between radical enactivism and classical representationalism, we might miss the woods for the trees, in at least two respects: first, by neglecting the relevance of other theoretical alternatives about representationalism in cognitive science; and second by not seeing how much REC and classical representationalism are in agreement concerning basic and problematic issues dealing with mental content (...) and intentionality. In order to expand and exemplify these ideas, this paper presents two heterodox positions on intentionality and on the relations between content and representation. Special attention is paid to the way REC is rejecting these positions: I argue that this rejection reveals common assumptions with classical representationalism, but also undermines the coherence of REC’s conception of intentionality. Les recherches de Pierre Hadot ont porte tout d'abord sur les rapports entre hellenisme et christianisme, puis sur la mystique neoplatonicienne et la philosophie de l'epoque hellenistique, et enfin sur la description du phenomene spirituel de la philosophie. Cet article commence par examiner trois justifications épistémiques de la démocratie, proposées par José Luis Martí, David Estlund et Hélène Landemore. Tous trois cherchent à montrer en quoi la démocratie possède une tendance à engendrer des décisions correctes, mais font face au risque de légitimer une organisation technocratique du politique, en contradiction avec le principe d’égalité politique. Ils estiment donc que l’argument épistémique ne peut pas suffire à justifier des institutions démocratiques. Cependant, si l’on comprend la valeur «épistémique» d’une décision (...) politique à la fois d’un point de vue factuel et normatif, c’est-à-dire qu’on considère à la fois sa rationalité et son impartialité, une justification épistémique de la démocratie beaucoup plus robuste émerge. Based on an endorsement of the hypothesis of extended cognition , this paper proposes a criticism of the representationalist assumptions that still pertain to these contemporary models of cognition. I first rehearse some basic problems akin to any representationalist model of cognition, before proposing some more specific arguments directed against the necessity, the plausibility, and the coherence of the marriage between extended cognition and contemporary representationalism . Extended and distributed models of cognition have the resources to get rid of representationalism, (...) and they should better do it. Their adherence to representationalism might be an by-product of the extended character of the scientific study of cognition. (shrink)

Les anecdotes et la réalité de l'écoute sont infinies", affirmait Luciano Berio. L'attention portée à l'écoute musicale occupe aujourd'hui une part importante de la recherche musicologique et ethnomusicologique. Cet ouvrage s'inscrit dans cette actualité et rassemble dix-huit essais autour de quatre axes : paradigmes de l'écoute ; l'écoute comme expérience ; l'écoute analysée ; chemins d'écoute. Il interroge l'écoute en tant qu'elle est multiple ou qu'elle s'intéresse à des multiples. Multiple s'entend tour à tour au sens de divers, de varié, (...) de pluriel, mais aussi de soumis à une itération ou à une réplication. Il est de plus en plus fréquent d'entendre parler d'éducation individualisée en même temps que communautaire grâce à l'échange et à l'entraide. Cet ouvrage présente sur le sujet une documentation très fouillée; la 1ère partie fait part des fondements et précurseurs de la méthode, les réalisations font l'objet de la 2e partie et tous les documents et exemples ont été placés en 3e partie.

Un aphorisme hante la philosophie occidentale. celui d'Héraclite, qui veut que " la Nature aime à se voiler ". Près de vingt-cinq siècles durant, ces quelques petits mots ont successivement signifié: que tout ce qui naît tend à mourir; que la Nature s'enveloppe dans des formes sensibles et dans des mythes; qu'elle cache en elle des vertus occultes ; mais également que l'Etre est originellement dans un état de contraction et de non-déploiement ; ou bien encore qu'il se dévoile en (...) se voilant. Ainsi cet aphorisme aura-t-il servi à expliquer les difficultés de la science de la nature, à justifier l'exégèse allégorique des textes bibliques ou à défendre le paganisme, à critiquer la violence faite à la nature par la technique et la mécanisation du monde, à expliquer enfin l'angoisse qu'inspire à l'homme moderne son être-au-monde. La même formule, illustrée par l'image du voile d'Isis et déployée par Pierre Hadot dans l'histoire de l'Occident, aura justifié, par suite de contresens créateurs, l'attitude prométhéenne - l'homme doit se rendre maître et possesseur de la Nature - comme l'attitude orphique - nul ne peut soulever le voile des mystères de la Nature, sinon le poète et l'artiste. Elle n'aura jamais cessé de tracer des perspectives nouvelles sur la réalité et de révéler les attitudes les plus diverses à l'égard de la Nature. Par là, elle confirme le propos de Nietzsche : " Une bonne sentence est trop dure à la dent du temps et tous les millénaires n'arrivent pas à la consommer, bien qu'elle serve à tout moment de nourriture. 1. Tout système juridique est production d’une histoire et d’une culture politiques déterminée, qui lui ont donné une organisation spécifique. Parler des limites de telles organisations peut s’entendre en deux sens, qui interagissent: premièrement, elles peuvent servir à différencier ces systèmes par rapport à d’autres ordres normatifs. Secondement, elles désignent ce que, par sa texture, le droit est hors d’état de réussir. 2. On comprend le concept de système comme une organisation aux structures différenciées de textes, de normes, d’acteurs. Ce (...) qui caractérise un système est son autoréférentialité et ses modes de clôture et ses modes d’ouverture. 3. Concernant la limite dans le second sens, on observera que la normativité comme mode d’action propre au droit le met souvent dans l’incapacité d’assumer pleinement les tâches de régulation qui lui sont confiées. Il s’agit d’une part d’une limite factuelle: celle de la technicité et du volume de ces tâches. D’autre part, la nécessité de plus en plus fréquente de prendre en compte les circonstances individuelles concrètes de l’application entraîne une légistique de diminution de la densité normative et, par conséquent, de déplacer une épistémologie fondée sur la répétition en direction de l’innovation. 4. Ces deux facteurs notamment font du droit un univers qui ne peut plus prétendre à une complétude cohérente: c’est un univers en constante évolution, qui exige pour sa mise en œuvre, de manière continue, l’apport d’informations provenant de son environnement. Ces apports circulent dans les modes d’ouverture du droit—la diminution de la densité normative et le recours à des expertises, des savoirs, des déontologies extérieures. Cependant, en vertu de l’autoréférentialité du droit, ces apports doivent être sélectionnés et juridicisés pour être intégrés dans le système juridique et préserver ainsi sa clôture. Il y a là une double programmation à respecter: la sélection doit d’une part respecter le cadre normatif du droit et de l’autre porter sur un choix correspondant aux attentes sociales qu’il s’agit de convaincre de son bien-fondé. Les limites du droit par rapport à d’autres ordres normatifs est ainsi définie par l’ordre juridique lui-même, dans le respect de cette double programmation. 5. Ce système a des présupposés politiques, culturels et historiques qui empêchent d’élaborer sans autre une essence du droit, valable urbi et orbi: notamment séparation des pouvoirs et liberté d’expression. Il n’est même pas certain qu’il puisse perdurer. En particulier, l’internalisation croissante du droit n’est guère conciliable avec son organisation telle que l’Occident l’a conçue. En outre, de plus en plus le droit devient l’objet d’une normativité supérieure, au nom de laquelle il est lui-même jugé: c’est le phénomène de l’économisation du droit. (shrink)

La formule célèbre d’Aristote « la nature ne fait rien en vain », telle qu’elle est utilisée dans le traité sur la Locomotion des animaux, invite à reformuler le problème général du finalisme en zoologie et de la conformité à la nature. Bien que cette formule, en première approche, semble aller dans le sens d’une téléologie cosmique ou globale, elle conduit en fait à privilégier une téléologie relative, c’est-à-dire locale, qui opère à l’échelle des êtres vivants. Elle s’applique en effet, (...) non pas de manière absolue, mais relativement aux possibilités définies par la nature de l’espèce (propriétés spécifiques et génériques). Toutefois, elle n’exprime pas seulement le rapport à la finalité organique stricto sensu, mais aussi les conditions nécessaires externes du mouvement animal, conditions qui définissent, pour les espèces et les genres, un régime commun d’organisation.
